This course investigates the ways in which the tort system has been reformed in the recent past, building on the foundation established in first year torts. Tort law as a method for regulating harm has been under attack in the United States. What are the criticisms of the tort system and how have regulators, legislators and judges responded? The course will cover subjects such as legal and scientific causation, products liability, preemption, mass torts, toxic and environmental torts, medical malpractice, workers' compensation, governmental torts and immunities, punitive damages and alternative compensation systems.
