    The Connecticut Law Review's virtual symposium examines the decision and what comes next for tribes and the state of Federal Indian Law after Brackeen.

    "[T]here is no resource . . . more vital to the continued existence and integrity of Indian tribes than their children . . . .” 25 U.S.C. § 1901(3).

    On June 15, 2023, the Supreme Court issued its decision in Haaland v. Brackeen. The case, which centered on the constitutionality of the Indian Child Welfare Act (ICWA) could have upended Federal Indian Law and tribal sovereignty in the United States. Tribes, scholars, and allies were nervous about the outcome. However, a 7-2 majority found in favor of the tribes and upheld ICWA, giving tribes a resounding win.

    While ICWA survives, the fate of Indian children and tribal nations remains at risk due to special interest groups and those who do not understand tribal sovereignty and the laws that protect it.
