Laura Foggan has been a leading advocate in the insurance coverage bar for more than 25 years. She has counseled insurance industry clients on strategic opportunities, litigation trends, and emerging risks such as COVID-19, autonomous vehicles and drones, privacy and cyber liability, global warming (climate change), internet-of-things (IoT), artificial intelligence (AI), and utilization of blockchain or distributed-ledger technology. She is experienced in a wide range of complex insurance matters, such as coverage disputes involving rescission, additional insureds, allocation, exhaustion, the duty to defend, settlement obligations, and the application of policy conditions and exclusions. She has represented insurers in significant first and third-party coverage matters, including bad faith and extra-contractual claims. Foggan has participated in more than 250 appellate cases including key national precedents on insurance issues. She has argued before numerous federal circuits and state appellate courts.
The American Law Institute appointed Foggan as the insurance industry liaison to the Institute’s Restatement of the Law, Liability Insurance.
Foggan has authored several law journal articles on insurance coverage and litigation topics. She co-teaches Liability Insurance and will be teaching Cyber Insurance at the University of Connecticut School of Law’s Insurance Law Center.
