Professor Richard Pomp spoke to Law360.com about a Georgia Supreme Court decision involving Uber and state sales taxes. The court vacated a lower court ruling that required Uber to collect and remit millions of dollars in sales taxes before the U.S. Supreme Court’s Wayfair decision. Pomp argued that the tax agency relied on a regulation that did not apply.

“The Court of Appeals acknowledged there is no specific statute that makes Uber liable for taxes on sales of transportation services, contrary to the department’s assessment based on a regulation. That should have been the end of the matter,” Pomp said.
